This is the privacy policy of the Law Firm “Legale Albania “Law & Tax”, (hereinafter referred to as “Legale Albania ” or “Owner”), with registered office at “Myslym Shyri” Street, DOMUS Residence, 4 Floor, Suites 16 – 17, Municipality No. 10, Postal Code 1001, Tirana, Albania, which aims to inform the interested parties about the methods of collection, processing, dissemination, storage and security measures adopted for the data declared on the web page. These processes are carried out in full compliance with the provisions of the legal and regulatory framework for the protection of personal data in the Republic of Albania. All data entered on the official web page https://legalealbania.com , as well as data that can be obtained through it, are subject to the Constitution of the Republic of Albania, European legislation (GDPR 2016/679), Law No. 9887 of 10.03.2008 “On the Protection of Personal Data” as amended, Law No. 9918 of 19.05.2008 “On Electronic Communications in the Republic of Albania” as amended, as well as other regulatory provisions.
1. Type of personal data and their use
“Legale Albania”, as the controller of personal data, is subject to the obligation to maintain the confidentiality of the information and processes personal data in accordance with the legislation in force. The type of personal data that will be processed are:
a) personal data of visitors to the website;
b) personal data of candidates for employment.
For visitors to our website https://legalealbania.com/, the system collects standard information, related to their online registration, clicks on the sections of this page, reading publications or announcements. This information is collected for statistical purposes (to show the access of visitors and therefore the interest of the interested parties without making them identifiable). We, as the Controller of personal data, collect this information in such a way that does not identify any visitor and we do not make any attempt to discover the identity of visitors who have visited our website.
The processing of personal data will be carried out in paper form and/or by electronic and/or telematic means and in any case according to the methods and tools appropriate to guarantee the security and confidentiality of the data in compliance with current legislation. In particular, all technical, IT, organizational, logistical and procedural security measures will be adopted in order to guarantee the protection of personal data required by law, allowing their use only by authorized persons and appointed by the Data Controller for this purpose.
Furthermore, when filling out the form and online sections, the provision of personal data is required. The data of candidates for hiring are sent to the Data Controller in the form of a Curriculum vitae (“CV”) via the online service, e-mail, or by physically presenting themselves at the premises of “Legale Albania”. Such data are not communicated to third parties, but are forwarded automatically to the employees responsible for their processing and the selection of work personnel. Sending the CV may represent:
a) spontaneous application of the candidate for hiring;
b) application based on a job vacancy notice.
The registration section lists several sub-sections, which contain the search for personal data consisting of: identification data, e-mail address, telephone number, work experience, studies completed, computer and language skills, data which are provided by candidates as part of the verification and selection procedures according to the job position. The compilation of the data in this form is required only for legitimate purposes and in compliance with the legal obligations of the Owner. The personal data relating to unsuccessful candidates are retained for 3 months after the closing of the recruitment competition, after which they are destroyed or completely deleted. The personal data relating to candidates interviewed and assessed as interesting for hiring, but not necessary for immediate acceptance for that job position, will be entered into a special database and will be retained for a period of 12 months in electronic or manual format. Data relating to spontaneous job applications will be retained and deleted if, 24 months after the date of their confirmation, the interested party has not been contacted for an initial interview.
2. Protection of personal data
The protection of personal data is based on:
a) processing in a lawful and legitimate manner;
b) collection for specific, clearly defined and legitimate purposes and their processing in accordance with such purposes;
c) adequacy of the data, which must be related to the purpose for which they are processed and must not exceed such purposes;
d) the accuracy that the data must have and, when necessary, must be updated, adopting every measure necessary to delete or rectify inaccurate or incomplete data, in relation to the purpose for which they were collected;
e) storage in such a form as to permit identification of the interested parties for a period not exceeding that necessary for the purpose for which they were collected.
3. Rights of the Data Subject
You can request information on the categories, the retention period, the data controllers and the purposes of the processing of the data that we process about you and the relationship with us and the form that such processing takes. If we process inaccurate or incomplete personal data, you can ask for the correction or completion of the data. You can ask for the unlawfully processed data to be deleted. If you believe that your rights, freedoms or legitimate interests in personal data have been violated, you can submit a complaint in writing to our address or by email. In all cases, we ask you to use the contact details listed below and to present proof of your identity.
4. Personal data security measures
The Data Controller adopts appropriate organizational and technical measures to protect personal data from unlawful, accidental destruction, accidental loss, to protect access or dissemination by unauthorized persons, in particular when data processing occurs online, as well as from any other unlawful form of processing. The Data Controller has undertaken to rigorously implement the regulatory framework in the protection and compliance with any action relating to user data, as provided for by Law no. 9887 of 10.03.2008, "On the protection of personal data", amended, as well as any other act approved by the Guarantor for the Right to Information and the Protection of Personal Data.
In no case will personal data be disseminated, except in cases provided for by law, furthermore "Legale Albania" does not transmit such data to third parties. The data documentation is kept for the time necessary for the purpose for which it was collected. For this reason, the recognition or any processing of the data recorded in the archive for a purpose other than that of their collection is prohibited.
The owner and each person authorized to process the data is subject to the obligation to maintain the confidentiality of the information even after the cessation of the exercise of this function. For this reason, these persons are provided with instructions and training to enable them to understand and implement their responsibilities in terms of security.
5. The right to lodge a complaint
Anyone who claims that his or her rights, freedoms and legitimate interests in relation to personal data have been violated has the right to lodge a complaint or notify the Guarantor and request its intervention to enforce the violated right. After such a complaint, in accordance with the Albanian legislation in force, the interested party may appeal to the courts.
